Terms and Conditions PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site. 1. General Conditions These general terms of business apply to every closed contract with the MRCA Mushroom Research Centre GmbH over their web shop "magicmushrooms.org". You agree that jurisdiction over and venue in any legal proceeding shall be in the state or federal courts located in Innsbruck, Austria in conformity with the Austrian Law especially Austrian Consumer Protection Law (?sterreichisches Konsumentenschutzgesetzt). 2. Contract Conclusion: All offers in our web shop count concerning the level of inventory are subject to change. Due to the risk of deterioration parts of our sales program are permanently fresh produced. We specifically point out, that as a result of unforeseeable exceeded demand the date of delivery for some of our products may delay. A binding contract is closed by payment of the costumer. The booking is delivered promptly when cashed. To avoid a deterioration of our products (e.g. throughout the weekends in shipping warehouses) we will take care of shipping within one week. If a specific product is out of stock, we will inform the costumer via e-mail and offer you an equal available product. We close contracts only with people aged at least 18 (in words: eighteen). To ensure this we need a copy of your proof of age by telex, mail or e-mail before we can execute your first booking. 3. Prices The quoted prices include the value added tax (VAT) and are calculated ex works 6020 Innsbruck, and so do not include postage and packing. The exact mailing expenses are being calculated at the end of the order process. Orders outside the customs territory of the EU (European Union) may accumulate additional custom duties and taxes. These are going to be levied by our shipper at the delivery of the goods. Your responsible costumes authority or tax office may inform you about the exact amount of these taxes and custom duties. 4. Right Of Withdrawal according to § 5e KSchG (Konsumentenschutzgesetz) You have the right to cancel your contract within 14 business days beginning with the delivery of the goods. Therefore you have to include the original invoice or quote the order number when returning the products. As a matter of principle we can only take unused goods back. From this right of withdrawal excluded are perishables (in particular mycels) as well as special orders and orders which are produced and designed according to a specific customers wishes. Upon redelivery of the merchandise we will refund the full amount paid less the mailing expenses, which have to be borne by the customer. The same applies to cases where a costumer rejects a delivery. 5. Warranty Austrian law applies. For equipment a two year warranty applies from date of purchase. From this warranty excluded are consumables and perishables. 6. Liability and Damages If any disputes about any concluded contract occur jurisdiction over and venue in any legal proceeding shall be in the state or federal courts located in Innsbruck, Austria in conformity with the Austrian Law. The place of fulfilment is located in Innsbruck, Austria too. 7. Damage in Transit We have transport insurance for all shippings via DPD. Claim all damages at acceptance of the goods and you will be refunded by the shipper (DPD) for the amount of loss. 8. We exclude liability for any damages especially injury to persons - that occur from inappropriate usage (not as mentioned in the instructions manual; i.e. eating mushrooms that are not eatable) of our products. 9. Shipping outside the costumes area of the European Union: We strike out that all custom duties and taxes are cashed by our shipping company at the delivery of the goods and have to be paid by the addressee. Your responsible costumes authority or tax office may inform you about the exact amount of these taxes and custom duties. A couple of countries may have barriers to import for some of our products. Please inform yourself before booking at your costumes authority and send all required documents (i.e. a pharmacist license) directly to us. Goods that can't be exported due to missing documents are returned directly to us before leaving the European Union. That is to protect the costumers from violating import bans. Needless to say that we take all goods back and refund the full amount paid less mailing expenses and perishables. 10. All articles mentioned above apply only for contracts where the costumer is a consumer in terms of the Austrian Consumer Protection Law (österreichisches Konsumentenschutzgesetzt). If any article of these conditions of use should get ineffective, all others hold up. If the costumer is a trader and thus buying goods as business activity we ask for direct contact for reseller discount and delivery terms. Inside the European Union we can only accept traders and resellers with a valid UID number. All personal data are subject to data protection. We store them according to the accounting law just as long as required.
